Quando a Constituição da República Portuguesa permite às Regiões Autónomas a proposta dos seus estatutos; quando essa definição, em conformidade com a amplitude constitucional, pode atingir graus de aprofundamento nunca antes alcançados, eis que, em vez de uma atitude de melhoramento sério e útil, vão-se fazendo pequenos acertos de pormenor - como a história das revisões dos Estatutos demonstram e como a que está a decorrer vai demonstrar, infelizmente.20
Está, neste momento, em desenvolvimento uma terceira alteração ao Estatuto Político- -Administrativo da Região Autónoma dos Açores. A Constituição prevê as regiões autónomas dos Açores e da Madeira, instituindo muitas das suas atribuições e competências e prevendo também que os poderes são subsequentemente definidos nos estatutos das duas regiões autónomas. Portanto, a Constituição, para além de fundamentar a existência de regiões políticas, de instituir os seus poderes de forma genérica, de conceber os seus órgãos e o órgão que representa o Estado no território autónomo, e para além de edificar normas sobre cooperação e vida política no âmbito da assinatura das leis regionais e da dissolução dos órgãos próprios, para além disso tudo a Constituição determina que os seus poderes são definidos nos estatutos.
Para a Constituição, portanto, independentemente do valor, para mais ou para menos, que se queira oferecer às palavras que os Açores (e a Madeira) têm os poderes «a definir nos respectivos estatutos», é nestes que se desenvolvem toda a filosofia constitucional.
É na base dessa realidade constitucional que as regiões autónomas podem usufruir de poderes amplos ou restritos mas sempre na perspectiva de garantir o elemento teleológico fundamental da Constituição para a região autónoma: pessoa colectiva pública de âmbito territorial com poder e atribuição e competência para garantir a participação democrática dos cidadãos numa dimensão da dignidade da pessoa humana.
E é, talvez, na base disso que algumas vozes perspectivam o Estatuto num sentido restritivo, incluindo a ideia de que o Estatuto apenas define os poderes que a Constituição prevê e não que o Estatuto, na definição desses poderes, crie um verdadeiro sistema. Não é pelo simples facto de os Estatutos possuírem muitíssimas normas que não são meras definições que se pode afirmar que, efectivamente, eles têm a capacidade para criar.
