As leis de finanças das Regiões Autónomas, quer a que está em vigor, quer a que se quer aprovar, são, não apenas contra a Constituição da República, mas contra o sistema autonómico porque dependem de vontades políticas conjunturais.38
Nota prévia: a lei de que falamos não é lei, mas apenas um projecto de lei que o Governo está a preparar para alterar a actual Lei. Falta-lhe, pois, a aprovação pela Assembleia, da promulgação do Presidente da República, da referenda do Governo (Primeiro-Ministro) e da publicação no Diário da República Electrónico.39
A discussão a propósito da alteração da lei de finanças das regiões autónomas (LEFRA) é uma discussão frequentemente financeira. Quanto se recebe?, mais ou menos do que se recebia? A democracia dever-se-ia designar, não democracia participativa, mas democracia financeira. Em rigor, a democracia sempre foi, de uma ou outra forma, participativa, mas nunca o foi tão financeira. Mas é uma discussão perigosa: quando política (e sempre o foi) é atendível, mas não quando preenche inutilmente o discurso sociológico de todo o cidadão.
A questão central da LEFRA não é financeira, mas sobretudo política. E adentro desta, não é um assunto exclusivamente de autonomia política, mas especialmente de participação democrática. Nem sequer se justifica uma LEFRA. A Região Autónoma é um ente público como o Estado. Este tem uma dimensão própria de unidade nacional, aquela também: a diferença está que ele representa e projecta-se no todo, enquanto ela apenas uma numa parte.
O que é o Estado? Já não se pode mirar com base no velho dogma de que é um povo organizado num território (LUIGI FERRAJOLI, " La Sovranità nel Mondo Moderno", 2002). É uma faceta de um certo contrato. O contrato actual é o de um Estado unitário, isto é, um único Estado com descentralização política interna, com as regiões autónomas. Mas o contrato poderia ser outro: ou com vários Estados e Distrito reunidos numa federação, como nos Estados Unidos da América, ou com várias regiões e cidades autónomas como em Espanha. Ou seja, o contrato depende do cidadão.
O Estado, em nome do povo, decide dividir-se em partes (muitas das vezes para não deixar partir-se em vários bocados, como por exemplo, num certo plano, em Espanha e Itália, e num outro plano, Alemanha e França). Se cria um órgão oferece-lhe financiamento anual; se cria uma autarquia local, oferece-lhe financiamento anual. Mas diferentemente, se cria uma região Page 63 autónoma política...
