Dissemos no texto anterior que podíamos não incluir todos os decretos legislativos regionais da primeira sessão legislativa (da oitava legislatura) porque, estando encerrados os parlamentos, poderiam, no entanto, existir ainda resquícios de diplomas nos corredores palacianos das assinaturas do Ministro de República para a região ou da respectiva publicação. 23E, efectivamente, isso aconteceu: afinal daquela primeira sessão temos ainda 7 diplomas dos Açores (e seria mais um se não tivesse sido sujeito ao veto jurídico do Ministro da República e se não tivesse sido declarado desconforme a Constituição pelo Acórdão 415/2005 do Tribunal Constitucional; a este oportunamente dedicaremos algum tempo) e outros 6 diplomas da Madeira.
Também dissemos, em conclusão, que a criação de Direito sob o corolário do novo sistema legislativo oriundo da Revisão Constitucional de 2004 tinha sido zero. E, novamente, verificamos essa mesma realidade.
Quanto aos Açores: dos sete decretos legislativos regionais dois são sobre orgânicas já existentes, Lotaçor e Fundo de apoio à coesão e desenvolvimento económico. Um de apoio à construção de habitação própria, matéria também já legislada. Novidades, um sobre apoio à promoção do destino turístico dos Açores, mas que era já matéria possível, evidentemente, da capacidade da Região muitos antes de 2004, e, de igual modo, regime de apoio ao combate à infestação por térmitas. Ainda um sobre o estatuto do aluno que, sendo uma certa novidade, não é, no entanto, nada que não se pudesse fazer antes.
E por fim um que transpõe a directiva comunitária referente à utilização das lamas de depuração na agricultura. Não é, no rigor da técnica legística, uma verdadeira transposição: é uma cópia melhorada do que já existia a nível nacional desde 1991. Tudo quanto é concepção é cópia, restando alguns aspectos como o valor das coimas, o destino das receitas e umas medidas de 50 e 100 metros que passaram para 60 e 150. Mas isso é alteração da lei estadual - não transposição de directiva. Não é um caso tão radical como o que apontámos no texto da página 27, mas continua sendo um falso alarme, isto é, um título que não corresponde à realidade. Coisa estranha: no Preâmbulo do diploma regional não há uma única referência à lei estadual. Porquê?
