Sem dúvida que a evolução constitucional da alteração das atribuições do Ministro da República, agora Representante da República, foi sintomática do ponto de vista político.27 Mas ao nível de sistema, são alterações mais de forma do que de conteúdo. Se antes o Presidente da República tinha na Região uma representação simbólica, hoje passará a ter uma representação à sua medida.
Regra geral raramente se fala do Presidente da República a propósito das regiões autónomas. O recorrente é falar-se do Ministro da República para a Região Autónoma e do Tribunal Constitucional. Mas o sistema autonómico é afinal baseado numa estrutura tripolar política em que se entrelaçam os órgãos próprios da Região com o seu respectivo Ministro da República e o Presidente da República - e hoje a realidade aponta para novos caminhos.
Um apontamento inicial: pela revisão Constitucional de 2004 a designação de Ministro da República foi alterada para Representante da República. Já falámos nisso em textos anteriores. E esse cargo será, pela primeira vez exercido, depois de em Março de 2006 o Presidente da República tomar posse.
Que significado pode encontrar-se no novo modelo constitucional, conjugado com os complementos do Estatuto Político-Administrativo, de deveres e poderes do Representante da República?
Se desde o texto constitucional de 1976 (passando pelos textos de 1982, 1989 e 1992) o Ministro da República representava a "Soberania" isso nada afigurava em termos práticos. O mesmo entendimento se pode afirmar quando desde o texto de 1997 (passando pelo de 2002) o Ministro da República representava o "Estado". Por isso, pois, não percebemos onde possa, no futuro, a designação de Representante da República, agora em representação da "República", pelo texto de 2004 encaminhar para resultados práticos.
Há uma ilusão óptica do ponto de vista político (já não técnico): Representante da República como representante da "República" conduz a um estatuto de menor categoria do que o de Ministro da República representante ou da "Soberania" ou do "Estado". Será isso que justificará, pela primeira vez na história, um nome açoriano no cargo?
Mais substancial a competência do Representante da República quanto ao Estado.
