O princípio constitucional da audição das Regiões Autónomas é um paradigma nas revisões da Constituição Portuguesa.57
O QUE É? O princípio da audição das regiões autónomas é um dos pilares que sustentam o regime autonómico. O princípio consiste no dever constitucional de os órgãos de soberania, a Assembleia da República e o Governo da República, auscultarem os órgãos próprios da região autónoma, em especial a Assembleia Legislativa, sempre que em questões de sua competência e sobre as quais vão tomar uma decisão aquelas digam respeito à respectiva região autónoma. Trata-se de um princípio lato, não direccionado para certa matéria ou para certo órgão, mas, mais abrangentemente, para toda e qualquer matéria que diga respeito à região insular e sobre a qual o órgão do Estado vá deliberar. Ou seja, é um princípio que tanto pode ser utilizado em procedimentos administrativos como legislativos. No entanto, tal princípio da audição adquire uma dimensão fundamental no processo legislativo - e a prática de cerca de trinta anos demonstra isso mesmo.
Mas, enquanto a audição é (ainda assim parcialmente) feita para a criação da lei ordinária ("lei" e decreto-lei; mas não só, também outros actos normativos menores como o decreto regulamentar, a portaria e o despacho normativo) o mesmo já não acontece com a lei constitucional. Por isso pode perguntar-se se existe ou não o dever constitucional de audição das regiões autónomas aquando das revisões constitucionais.
DONDE VEM? Um dos princípios fundamentais da Constituição Portuguesa é o da audição dos órgãos regionais. Na ideia de DESCARTES sobre o conceito de "princípio", "este é aquele que escolhido está apropriado à partida do curso com o acompanhamento no percurso restante". E isso, naquele sentido, foi e é precisamente a natureza do nosso princípio porque foi criado em 1976 e manteve-se inalterado em todas as revisões constitucionais (1982, 1989, 1992, 1997, 2001 e 2004) neste preciso articulado: «os órgãos de soberania ouvirão sempre, relativamente às questões da sua competência respeitantes às regiões autónomas, os órgãos de governo regional».
INSTITUIÇÃO Tudo foi sendo alterado ao longo das seis revisões constitucionais, mas não aquele texto constitucional do princípio da audição que se manteve com todas as letras igual.
